Terms and Conditions of Training Services
Effective Date: [01 July 2025]
1. Introduction
These Terms and Conditions govern the participation in and engagement with all training programs offered by Bramolyness Training Consultants ("Bramolyness", "we", "us", or "our"). By registering or engaging with our services, you ("Client", "Participant", or "Organization") agree to be bound by these terms.
2. Registration and Confirmation

All training registrations must be made through official Bramolyness channels (email, website, or signed engagement forms).

Confirmation is subject to availability and receipt of a signed registration form or agreement.

We reserve the right to decline or reschedule a registration in cases of over-subscription or unforeseen circumstances.
3. Payment Terms

Full payment or a mutually agreed deposit must be received at least five (5) business days before the training start date.

Payment may be made via bank transfer, M-Pesa, cheque, or other approved channels.

Fees cover training materials, facilitation, refreshments, and certification (unless otherwise stated).
4. Cancellations, Substitutions, and Refunds
By Participant/Client:

Cancellations made more than 14 business days before the training will receive a full refund (minus admin fees, if any).

Cancellations made within 3–7 business days will be subject to a 50% cancellation fee.

No refunds will be issued for cancellations made less than 3 business days before the training.

Participant substitutions are allowed with prior written notice up to 48 hours before the training.
By Bramolyness:

We reserve the right to postpone, cancel, or reschedule training due to low enrollment, force majeure, or facilitator unavailability. In such cases, clients will be offered alternate dates, where the said payment will be utilized for the intended purpose.
5. Training Delivery

Trainings are delivered through in-person, virtual, or hybrid models as specified in the registration.

Bramolyness reserves the right to adjust the training format, content delivery, and facilitators when necessary to enhance learning outcomes.
6. Intellectual Property

All training materials, including but not limited to manuals, slides, and toolkits, remain the intellectual property of Bramolyness or its content partners.

Materials are provided for personal or internal organizational use only. They may not be reproduced, distributed, or used for commercial purposes without prior written consent.
7. Confidentiality

Bramolyness commits to maintaining the confidentiality of all proprietary information shared by clients during training engagements.

Participants are also expected to respect the confidentiality of shared case studies or peer contributions during group sessions.
8. Code of Conduct

Participants are expected to behave professionally and respectfully during all training activities.

Bramolyness reserves the right to remove any participant whose behavior disrupts the learning environment or violates ethical standards.
9. Data Protection and Privacy

Bramolyness collects personal data (e.g., name, contact information) solely for the purposes of registration, certification, and training administration.

Your information will not be shared with third parties without your consent, except as required by law or certification partners.
10. Limitation of Liability

Bramolyness shall not be held liable for any indirect or consequential damages arising from participation in our trainings.

In no event shall our liability exceed 85% of the amount paid for the training in question.
11. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Kenya. Any disputes shall be resolved through amicable negotiation or, failing that, through arbitration in accordance with Kenyan law.
12. Amendments

Bramolyness reserves the right to update or revise these Terms and Conditions from time to time. Updated versions will be posted on our website or sent to clients upon request.
